Maloney Industries provides AI-assisted marketing products and services, offered directly and through partner agencies. Features may change over time.

Accounts

You are responsible for the accuracy of information you provide and for activity under your account. Keep your credentials secure.

Do not misuse the services: no unlawful, infringing, harmful, or abusive use; no attempt to disrupt or gain unauthorized access; no use that violates a third party's rights or an advertising platform's policies.

Intellectual property

We retain all rights in our software, models, methods, and content. You retain rights in the business information and materials you provide. Deliverables and ownership are governed by your service agreement (directly or through your partner agency).

Payment

Fees, billing, and any advertising spend are governed by your service agreement or your partner agency's agreement. Advertising media spend is authorized and paid by the customer.

The services are provided “as is,” without warranties of any kind. We do not guarantee any specific marketing result or outcome.

Limitation of liability

To the fullest extent permitted by law, Maloney Industries is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid for the services in the three months before the claim.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.

Changes

We may update these Terms; continued use after an update means you accept the revised Terms.
